Union Minister Nitin Gadkari highlighted the alarming road safety situation in India. In 2023, there were 4,62,000 road accidents, leading to 20 deaths every hour and 55 crashes per hour. Shockingly, 72% of these accidents occurred due to over-speeding.

In an ideal scenario, if someone crashes into your car, their insurance should compensate you. But in India, that rarely happens. Let’s explore why third-party insurance claims are so difficult.

The Complex Process of Claiming Third-Party Insurance

If your car is damaged due to another party’s negligence, claiming third-party insurance is a bureaucratic maze:

  1. Inform Your Insurance Company: You must notify your insurer immediately.
  2. File an FIR: The police must register an FIR for legal proceedings to begin.
  3. Gather Evidence: Every detail of the accident must be documented.
  4. Identify the At-Fault Party’s Insurance: Details such as their insurer’s name and policy number are crucial.
  5. Approach the MACT Court: The Motor Accident Claims Tribunal (MACT) handles third-party claims.
  6. Legal Battles: The at-fault party’s insurer and lawyer will try to shift the blame onto you.
  7. Long Wait for Compensation: Settlements take months, if not years, and payouts are often much lower than expected.

Due to these hurdles, most people avoid third-party claims and end up paying for the damages themselves or using their own insurance, losing their no-claim bonus in the process.

How Does Third-Party Insurance Work Abroad?

Unlike India, third-party insurance claims are much simpler in countries like the US, UK, and Germany.

  • United States: No need to go to court or file a police report. Simply submit evidence to the insurance company and receive compensation.
  • United Kingdom: The at-fault party’s insurer investigates the claim and compensates the victim without police or court involvement.
  • Germany & Italy: Similar to the UK, claims are handled directly between insurance companies, ensuring faster settlements.

This ease of claiming insurance contributes to less road rage abroad, as people trust the system. In India, the lack of compensation often leads to fights and disputes at accident scenes.

Why Indians Must Be Cautious While Buying Insurance

A real-life example highlights why vigilance is essential. A well-known content creator, Labor Law Adviser, shared his experience where his insurance policy was active on the insurer’s app but not on the government’s mParivahan portal due to a missing chassis number. Had he been in an accident, his claim would have been denied.

Must-Have Insurance Add-Ons

To protect yourself from financial loss, consider the following insurance add-ons:

  • Personal Accident Cover: Covers medical expenses after an accident.
  • Zero Depreciation Cover: Prevents depreciation deductions on claim amounts.
